There has been quite a bit of discussion by people regarding the use of troops being used to protect federal property within Portland, Oregon. Especially federal buildings that have been experiencing ongoing issues.

Including Tina Kotek, who abandoned the office of governor, taking legal action to halt the use of the Oregon National Guard. Which is also referred to the organized militia of Oregon.

As I stated while running for Attorney General of Oregon, Tina Kotek abaondoned the office of governor by failing to take action when a Marion County Sherriff's Deputy threatened permenent harm in 2023 to Tina Kotek. As well as the president of the United States of America. Who at the time was Joe Biden.

Meaning that under Oregon Constitution Article V Shemia Fagan became the lawful governor of Oregon. The line of succession for governor in early 2023 was Shemia Fagan, Tobias Reed, Robert Wagner, and ending with Dan Rayfield.

Oregon Constitution Article V, section 10 provides that the governor "shall take care that the laws be faithfully executed."

Someone threatening permanent harm to someone under such circumstances, especially a high level elected official, is clearly in violation ORS 182.030 Employment of persons advocating violent overthrow of the Government of the United States or Oregon prohibited

Providing:

"(1) No state department, board or commission shall knowingly employ any person who either directly or indirectly carries on, advocates, teaches, justifies, aids or abets a program of sabotage, force and violence, sedition or treason against the Government of the United States or of the State of Oregon."

Depending on what considers a reasonable period of time, Shemia Fagan lawfully became governor of Oregon as early as February 2023, or as late as mid April 2023. Before any resignation from the office of Secretary of State of Oregon.

Relevant case law in Oregon is State ex rel O'Hara v Appling 215 Or 303; 334 P2d 482 (1959).

So while Donald Trump should be communicating with either Shemia Fagan, or failing that Tobias Reed, meaning that he is communicating with the wrong individual, Donald Trump is well with the right to fulfill the obligation to ensure the safety of federal property.
